701-3 Eligibility Decisions

Previous Policy

  1. Deadline for Determining Eligibility

A.     An eligibility decision must be made within 30 days of the date of the application. If a decision cannot be reached within 30 days, document the cause of the delay in the case record.

B.      If unverified eligibility factors do not affect the eligibility of the entire household (e.g., the alien status of one child), the application may be approved for those members determined eligible. The application cannot be approved if unverified eligibility factors affect the entire household (e.g., wages of a parent.)

  1. Certification of Decision

Record the eligibility decision in the case notes.

  1. Notification of Approval or Denial

Notify the applicant in writing of the approval or denial, the reason for the action, a citation of the regulation upon which the action is based, and who to contact for information on the income method used to compute the CHIP eligibility.

  1. Verifications provided after the application period

A.   If verifications are provided within the 30 days after an application has been denied, the date that all of the necessary verifications are received will be treated as the new application date. The client does not have to complete a new application form.  All eligibility factors, including income, must be considered.

B.  If verifications are returned more than 30 days after the application has been denied, the client will have to re-apply.
