If a hearing request is submitted through the Local Office, supervisors should contact the enrollee to see if an agency conference would resolve the problem. They should tell the enrollee he does not have to have an agency conference if he does not want one. Do not delay sending the hearing request to the Department of Health, Hearings Office.
When a supervisor or worker receives a notice of a scheduled fair hearing, they should check to see if the enrollee has been offered an agency conference. If not, the supervisor or worker should contact the enrollee or representative as soon as possible.
Tell the enrollee or representative you would like to see if an agency conference would resolve the problem. But tell them they do not have to have it if they don't want to.
Tell the enrollee or representative they can still have the hearing if they don't think the agency conference solved the problem.
Tell the enrollee or representative they can have an authorized representative attend the agency conference if they want.
After the agency conference, send the Hearing Officer a letter telling him what happened.
